Local Pharmacist in Legal Battle with Landlord Over Business Disruption

In Nahe, Schleswig-Holstein, a local pharmacist is facing a peculiar challenge as he battles his landlord over allegations of business sabotage. Arsalan Hidary, the proprietor of the pharmacy in the small community of 2,500 residents, found his entrance blocked by large piles of sand on April 16, preventing access to his establishment.

Hidary, who has been in a contentious relationship with his landlord, Brigitte W., for nearly a year, was taken aback by the sudden appearance of sand mounds around his pharmacy. The landlord had placed handwritten signs around the sand, prohibiting entry to certain areas, including a nighttime delivery section where suppliers drop off medications.

According to Hidary, Brigitte W. had previously operated the Roses Pharmacy herself before deciding to sell it to him after struggling to find a successor. The relationship soured after Hidary invested approximately EUR120,000 in the business, only for a commissioned inventory to reveal a stock valued at just EUR94,000, leading to disputes over finances.

The conflict escalated when the landlord failed to provide necessary documents for a company vehicle that was part of their agreement, and issues arose regarding heating during the winter months. Hidary asserted that the heating system was inadequate, prompting him to reduce his rent by 60% based on legal advice.

As customers began to express their opinions on the ongoing feud, some noted that the landlord was causing disturbances out of jealousy due to Hidary's growing popularity in the community. A regular patron mentioned that the landlord was feared in the region, suggesting that her actions were motivated by a desire to undermine Hidary's business.

In response to the sand blockade, Hidary successfully obtained a temporary injunction mandating the removal of the sand piles and maintaining access to the parking spaces. However, Brigitte W. contested this ruling, which was subsequently upheld by the Bad Segeberg District Court, ordering her to clear the area.

Despite the legal victory, Hidary remains skeptical about a resolution, suspecting that the landlord may continue to engage in disruptive behaviors due to her frustration with his success. Reports indicate that during a recent court appearance, Brigitte W. threatened to escalate the situation further with the installation of a high construction fence.

Attempts to reach Brigitte W. for comment on these allegations were unsuccessful, as she declined to engage with reporters and did not respond to written inquiries.
