France Reinstates Strict Age Verification Rules for Adult Websites

France has achieved a significant milestone in its ongoing battle with adult website operators regarding new youth protection regulations. The country's highest administrative court, the Council of State, has lifted a temporary suspension of stringent age verification measures that adult sites must now implement.

The ruling came after Hammy Media, the operator of the popular adult site xHamster, failed to demonstrate that the new regulations would cause the company immediate and severe financial harm. This decision reinstates the requirement for adult platforms to introduce more robust mechanisms to verify users' ages.

Under the newly enforced regulations, simply clicking a button to indicate one is over 18 is no longer sufficient. Instead, external verification services must confirm the age of users while maintaining their anonymity. The adult site will only receive a confirmation that the user is of legal age, without access to any personal identification. Meanwhile, the external service will know the user's identity but will not be privy to the reason for the age verification.

Recent statistics from France's digital regulatory authority, Arcom, revealed that approximately 2.3 million minors visit adult websites each month, representing about 12% of all users in the country.

The conflict regarding these regulations has been escalating for weeks. In early June, Aylo, the company behind popular platforms such as Pornhub, Redtube, and Youporn, temporarily blocked access to its content in protest against the new rules. Instead of adult content, users in France were met with a statement from the company addressing the age verification measures.

In a more aggressive response, xHamster's parent company took the issue to court. Although the Paris Administrative Court initially suspended the new regulations, the Council of State has now reversed that decision. While this ruling does not address the legality of the regulations themselves, it indicates that the dispute between adult entertainment companies and the French government is far from over, with further legal determinations expected.
