Court Rejects Google's Appeal in Epic Games Case

The Ninth Circuit Court of Appeals has dismissed Google's appeal regarding the jury's decision in the ongoing dispute with Epic Games over the App Store. This ruling could have significant implications for the future of app distribution on Android devices.

In December 2023, a jury found in favor of Epic Games, the developer behind Fortnite, determining that Google had misused its monopoly on the Android platform and had engaged in anti-competitive practices. Following this verdict, Judge James Donato established that Google must open its Play Store to alternative app stores and ensure that all apps are accessible in these stores unless developers choose otherwise.

Google filed an appeal against this ruling in late 2024, which temporarily halted the implementation of the court's orders. However, following the Appeals Court's recent decision, this suspension is expected to be lifted, and changes to the Play Store could soon be enacted.

In response to the ruling, Google expressed concerns, arguing that it would significantly compromise user security and stifle innovation on the Android platform. The company plans to pursue further legal action, potentially escalating the matter to the Supreme Court of the United States.

The legal battle began in 2020 when Epic Games initiated lawsuits against both Google and Apple. While Epic's case against Apple resulted in a loss, it achieved more favorable outcomes against Google. The courts criticized Google for its multi-billion dollar agreements with manufacturers like Samsung, which involved revenue sharing from Play Store sales in exchange for prioritizing the Play Store on their devices.

Epic has launched its own store for Android devices since last summer, but previous installation required users to download it as an APK file, limiting its app selection. However, Tim Sweeney, the CEO of Epic, has indicated plans to distribute the Epic Games Store through the Play Store in the future, potentially expanding its reach and accessibility.
