Court Awards EUR1 Million for Birth Injury to Nine-Year-Old

In a landmark ruling that has garnered significant attention, the Göttingen District Court has ordered a hospital to pay EUR1 million in damages to a nine-year-old girl who suffered severe injuries during childbirth. This ruling marks the highest compensation ever awarded by this court in cases of medical negligence.

The child's injuries stem from her birth in 2016 at a hospital in Göttingen, Lower Saxony, where serious errors were made by both the attending physician and midwife. According to the court, critical warning signs were ignored, leading to a failure to perform a timely emergency cesarean section. Furthermore, after the birth, the child did not receive adequate monitoring or oxygen support, and the specialized neonatal emergency service was not summoned promptly.

As a result of these oversights, the girl has been left with profound disabilities. She cannot speak, eat independently, and requires continuous care. Medical experts involved in the case concluded that her condition is unlikely to improve.

In light of these circumstances, the judges ruled that the responsible hospital should compensate the family with a record-setting amount for pain and suffering. Notably, the obstetrics department at the implicated hospital has since been closed due to these events.

While the verdict represents a significant milestone in medical liability cases, it is important to note that the hospital has the option to appeal the decision, and the ruling is not yet legally binding.
