Union Calls for Calm After Failed Election of Constitutional Court Judges

Sat 12th Jul, 2025

The coalition faces significant challenges following the unsuccessful election of judges to Germany's Constitutional Court. Leading members of the CDU/CSU parliamentary group have urged for a composed approach as discussions on this issue progress. The parliamentary managing director of the CDU, Steffen Bilger, emphasized the need for all parties involved to take a step back and engage in constructive dialogue with the SPD regarding the next steps.

This call for patience comes in response to a proposal from the SPD, suggesting that their controversial candidate for the Constitutional Court, Frauke Brosius-Gersdorf, should address the concerns of Union lawmakers directly. Alexander Hoffmann, head of the CSU parliamentary group, echoed this sentiment, highlighting the coalition's responsibility to reach a consensus on a candidate package for the court. He stressed the importance of taking time for deliberation to ensure respect for the court, the candidates, and the lawmakers who ultimately decide on the election.

The recent failure to elect two SPD nominees and one Union candidate was largely attributed to significant opposition within the Union, particularly regarding Brosius-Gersdorf due to her views on abortion. Despite previously nominating her in the selection committee, the Union's leadership had supported her candidacy before the backlash emerged.

Meanwhile, the SPD remains committed to its two candidates, with Brosius-Gersdorf yet to publicly confirm her availability to continue in the nomination process. Both Fraktionschef Jens Spahn and Chancellor Friedrich Merz of the Union have not yet provided comments on the situation, although Merz is expected to address the matter during an upcoming interview.
