A Romanian family residing in a Berlin emergency shelter was refused re-entry after returning from a ten-day trip to their home country. The family, which had been accommodated in a state-funded shelter in the Friedrichshain-Kreuzberg district, was informed prior to their departure that their place could not be guaranteed during extended absences. Despite this warning, the family chose to travel to Romania for a holiday.
Upon their return, the family requested to be reinstated in the same emergency accommodation, which reportedly costs the city approximately 5,000 euros per month for each household. The authorities, citing prior notification and previous breaches of the shelter's regulations, declined their request. These earlier infractions included unauthorized visitors and the consumption of alcohol and tobacco within the premises, both of which are prohibited under the shelter's rules.
The local social affairs councilor emphasized that emergency shelters are intended to address immediate threats such as homelessness. The councilor explained that if individuals leave their accommodation voluntarily for personal reasons, particularly for an extended period, they are considered to have relinquished their right to the space. The rationale is that public resources should not be committed to those who have alternative options or who can resolve their own housing situation.
In response to the refusal, the family submitted an urgent appeal to the Berlin Administrative Court, seeking provisional reinstatement in the shelter. The court dismissed the application, ruling that the family was not involuntarily homeless, as their actions had created and could resolve their housing situation independently. The judgment highlighted that public emergency accommodations are not intended for individuals who choose to leave and then expect to return under the same terms.
This case is seen as significant due to its potential impact on future policy and legal interpretations concerning social welfare accommodations. Traditionally, German courts have held that referring individuals to their country of origin is insufficient grounds for denying access to emergency shelters. However, the authorities in this instance view the court's decision as a shift towards stricter criteria, with plans to reassess similar cases based on this precedent.
The incident has prompted discussion about the appropriate use of public funds and the responsibilities of beneficiaries of state-supported housing. The local administration indicated that it would continue to evaluate similar cases in light of the court's guidance, reinforcing the principle that emergency shelters are designed for those in unavoidable need, not for those who can make alternative arrangements.
