The expansion of a beverage can manufacturing plant intended for Red Bull in Baruth/Mark, located approximately 50 kilometers south of Berlin, has been temporarily suspended following a decision by the Higher Administrative Court of Berlin-Brandenburg. The court declared the city's development plan for the industrial site as temporarily unenforceable, effectively stopping any scheduled tree felling activities for the facility's construction.
The proposed project, a collaboration between beverage companies Red Bull and Rauch, aimed to clear around 17 hectares of forest to facilitate the development of a new production campus. This initiative, backed by Brandenburg's Ministry of Economic Affairs, was expected to generate significant investment and create up to 300 additional jobs in the region.
Despite governmental support, the project drew criticism from environmental organizations, notably the environmental network Grüne Liga. The group challenged the city's development plan in court due to concerns about the potential environmental impact, including deforestation and possible water shortages. In response to the legal action, the court issued a preliminary order that prohibits construction based on the current plan until further notice.
The court's decision was rooted in a procedural flaw related to noise restrictions applied across the entire planned industrial site, rather than environmental concerns. As a result, the development plan is deemed invalid for the time being. This decision is not subject to appeal, and the main legal proceedings will determine the final outcome. The schedule for these proceedings has yet to be set.
Legal representatives of Grüne Liga emphasized that construction activities at the site are now on hold until a final ruling is made in the main proceedings. Should the court ultimately declare the plan invalid, the city may face significant efforts to revise and resubmit a compliant development plan.
Representatives for the beverage manufacturers acknowledged the court's decision and indicated that they would review its implications. The city of Baruth/Mark has not yet issued a public response to the ruling.
Despite the legal setback, the Brandenburg state government continues to endorse the expansion project. The Ministry of Economic Affairs views the planned investment as vital for regional economic growth and job creation. The proposed production campus by Red Bull and Rauch represents an investment estimated in the hundreds of millions of euros. According to project coordinators, water consumption at the new facility is not expected to exceed previous levels at the site, which was formerly operated by the Brandenburger Urstromquelle bottling company, acquired by Red Bull and Rauch in 2023.
The dispute mirrors similar concerns raised by environmental groups regarding industrial developments in Brandenburg, such as the Tesla automotive plant in Grünheide, where deforestation and water use have also been points of contention.
