The Federal Court of Justice has confirmed the prison sentence handed down to a woman convicted in connection with the fatal stabbing of a security guard at a refugee accommodation facility in Potsdam. The court rejected the defendant's appeal, supporting the Potsdam Regional Court's decision, which found no substantial legal errors in the original ruling.
The case centers around an incident that took place in May 2024, when a woman of South African nationality fatally stabbed a 33-year-old Syrian security guard. The altercation occurred within the premises of a refugee shelter, and the victim succumbed to his injuries in hospital shortly after the incident.
According to the findings of the Potsdam Regional Court, the defendant attacked the security guard with two knife wounds to the chest following a dispute. The court determined that her actions constituted manslaughter and dangerous bodily harm, resulting in a sentence of twelve years and eight months in prison. This sentence was in alignment with the prosecutor's recommendation, while the defense had sought an acquittal.
During the trial, the motivation behind the attack came under particular scrutiny. The court established that the defendant's primary aim was to prevent the imposition of another ban from the accommodation facility. She had previously been expelled from several similar residences in Potsdam for repeated misconduct, including incidents of verbal abuse, spitting at others, and engaging in physical altercations with fellow residents.
The defendant's behavioral history was taken into account, with the court noting her recurrent confrontations and disruptive actions in multiple facilities. These patterns contributed to the assessment of her intent and the circumstances leading up to the fatal event.
After the conviction was issued in April 2025, the defense filed an appeal, challenging the legal basis and findings of the initial trial. However, the Federal Court of Justice concluded that the lower court's examination and judgment were thorough and free of critical legal flaws. The appellate decision, made in January under case number 6 StR 473/25, rendered the original verdict legally binding.
The outcome of this case underscores the judicial system's commitment to upholding the rule of law in cases involving violent acts within communal living environments. It also highlights the challenges faced by both staff and residents within refugee accommodation settings, where tension and conflict can escalate to serious criminal offenses.
The case remains a notable example of the complexity involved in adjudicating violent incidents in sensitive contexts, and the legal processes that ensure accountability and justice for all parties involved.
