Online retail giant Amazon.com has been ordered to pay a staggering $1 billion in fines due to allegations of deceptive practices surrounding its Prime subscription service. The Federal Trade Commission (FTC) has accused Amazon of employing confusing and misleading design techniques to push millions of consumers into signing up for paid Prime memberships while making the cancellation process intentionally difficult.
This landmark ruling comes after an investigation initiated by the FTC in 2023, which revealed that Amazon had designed subscription traps that manipulated users into enrolling in Prime without their clear consent. The settlement, which the company and two of its executives have agreed to, represents approximately half of Amazon's average daily global revenue.
Under the terms of the agreement, Amazon must pay half of the penalty immediately, with the remainder due in 18 months. Additionally, the company is required to refund $1.5 billion to affected customers, marking it as the second-largest refund program the FTC has ever enforced. The only larger case involved Volkswagen, which was ordered to pay $9.5 billion in relation to its diesel emissions scandal.
FTC Chair Andrew N. Ferguson expressed severe concern over Amazon's tactics, stating that the evidence indicated the company had created sophisticated traps designed to ensnare consumers into Prime subscriptions. Internal documentation has reportedly referred to these practices as a 'sneaky cancer.'
Prior to the lawsuit, Amazon allegedly attempted to suppress documents and made false statements to impede the FTC's investigation, claims that the company refutes. The settlement aims to prevent such practices from occurring in the future, with specific measures mandated to improve transparency and consumer choice.
Among the new requirements, Amazon must implement a distinctly visible button for consumers to decline the Prime subscription during the checkout process. The FTC has emphasized that the option to reject Prime must be as prominent as any offer for free delivery.
Furthermore, Amazon is mandated to simplify the process for canceling subscriptions, ensuring it is neither complicated nor time-consuming. Customers should be able to cancel their subscriptions using the same method they used to sign up, a stipulation that currently applies only to consumers in the United States.
Many users have reported challenges in navigating the cancellation process. Personal experiences indicate that even attentive consumers can inadvertently enroll in unwanted Prime memberships due to a single misclick during the purchasing process. Individuals have recounted difficulties in finding cancellation options, often requiring assistance from Amazon representatives to resolve these issues.
The FTC has hailed this $1 billion fine as a historic enforcement action for violating its regulations. However, it is worth noting that the FTC has previously imposed larger fines based on different legal grounds, such as the $5 billion penalty levied against Facebook (Meta Platforms) following the Cambridge Analytica scandal.
