The German federal government has reached an agreement requiring major streaming platforms and broadcasters to increase their investment in European, particularly German, film and television productions. This initiative aims to revitalize domestic studios and support the country's creative industries.
Under the new legislation, companies such as Netflix, Amazon Prime, Disney+, and prominent television broadcasters, including both private and public entities, must allocate at least 8% of their annual net revenue generated in Germany to European productions. Additional requirements have been set for a minimum share of investments in German-language content, along with regulations regarding rights retention for domestic producers.
The policy stems from concerns within the government about the declining competitiveness of Germany as a production hub. Large studios, such as those in Babelsberg and Bavaria, have recently experienced a downturn in international projects, with major productions opting to locate elsewhere in Europe. Government officials argue that public funding alone is insufficient to attract large-scale projects, necessitating private sector participation to strengthen Germany's position in the global film industry.
Beyond the mandatory 8% investment, the framework offers incentives for companies willing to exceed this baseline. For instance, entities investing 12% or more may be granted flexibility in certain production rules, such as the language of filming, provided the projects are based in Germany. However, due to European Union regulations, the government cannot enforce an exclusively Germany-focused investment quota, but can require spending within the EU.
To further support the industry, the federal budget will provide an additional 120 million euros, increasing annual economic film funding to 250 million euros over multiple years. This funding boost is designed to create sustainable jobs and foster creative growth within the German film sector, ensuring that top talent in writing, directing, cinematography, and post-production remains within the country.
Industry reactions to the new measures have been mixed. Production alliances have welcomed the policy as a pivotal step for the German creative sector, highlighting the importance of clear regulations on rights retention for producers. However, some broadcasters, such as RTL, have raised concerns regarding regulatory intervention and its impact on their content autonomy, noting that the new obligations could present operational challenges for privately funded broadcasters. They have emphasized the importance of a balanced implementation that takes into account industry perspectives.
Within the government, there were initial disagreements concerning the extent and enforceability of the investment requirement. Some officials advocated for a voluntary approach, while others insisted on mandatory quotas to ensure meaningful investment. The compromise, reflected in the current policy, aligns with European standards and provides mechanisms for additional negotiation and flexibility.
