The Brazilian Supreme Court has officially allowed charges to be brought against former President Jair Bolsonaro, who is accused of attempting to orchestrate a coup following his electoral defeat to Luiz Inácio Lula da Silva. The court's decision, supported unanimously by all five justices of the First Chamber, formalizes the status of Bolsonaro and seven alleged co-conspirators as defendants in a criminal case.
The prosecution asserts that Bolsonaro, alongside his associates, plotted to undermine the government of his successor in the wake of the 2022 elections. Bolsonaro has denied the allegations, claiming they are unfounded and motivated by personal vendettas against him.
Investigators believe that Bolsonaro, a former military officer, conspired with his supporters to carry out a coup to maintain his grip on power after his defeat. This conspiracy allegedly culminated in the violent storming of the Brazilian Congress, presidential palace, and Supreme Court by Bolsonaro's supporters on January 8, 2023, who refused to accept Lula's victory. The attacks caused significant damage and drew international condemnation.
Judge Alexandre de Moraes, who presided over the case, stated that the criminal organization had taken all necessary steps to overthrow the duly elected government but was thwarted when military leadership declined to support the coup.
Bolsonaro's actions and rhetoric during his presidency earned him comparisons to former U.S. President Donald Trump, particularly following the Capitol riots in January 2021. Like Trump, Bolsonaro has consistently questioned the legitimacy of his electoral loss without providing substantial evidence to support his claims.
In addition to Bolsonaro, seven other individuals, including former heads of various government departments, are also implicated in the case. These include former Justice Minister Anderson Torres and former Defense Minister Braga Netto, all of whom have denied the accusations against them.
Bolsonaro has stated that while he supports peaceful protests against Lula's presidency, he does not condone violence. Nonetheless, he has repeatedly cast doubt on the legitimacy of the election results, which has fueled tensions among his supporters.
The Supreme Court will now proceed with the trial phase, during which the prosecution and defense can present evidence and summon witnesses. A ruling on the case will determine whether the defendants are convicted or acquitted.
If found guilty of the coup charges, Bolsonaro and his co-defendants could face imprisonment of up to twelve years. Importantly, there are no avenues for appeal against the Supreme Court's verdict. Additionally, Bolsonaro has been barred from holding public office until 2030.
Multiple legal proceedings against Bolsonaro are currently ongoing, including allegations that he illegally profited from gifts received during his presidency, such as jewelry and luxury watches. He has consistently denied these claims. Authorities have also accused him of falsifying vaccination documents during the COVID-19 pandemic for himself and his associates.
