The migration policy of the new German black-red coalition faces significant challenges as Poland has recently blocked the deportation of two Afghan asylum seekers. This incident occurred on Monday morning, May 12, when Polish border authorities intervened, halting the return of the two individuals who had reportedly entered Brandenburg illegally, according to the German Federal Police.
Following their apprehension, the Afghan men were taken to an initial reception facility. They were found without identification documents and expressed their intention to seek asylum in Germany. Despite a directive from German Interior Minister Dobrindt to return them, Poland formally rejected this request, citing the ongoing asylum process as the basis for their refusal. Consequently, under the Dublin Regulation, Germany is initially responsible for processing their asylum claims.
During a meeting in Warsaw, Polish Prime Minister Donald Tusk emphasized the importance of maintaining free passage between Germany and Poland, highlighting mutual interests in addressing migration challenges. The Swiss government also expressed concerns regarding the German administration's approach to border controls and deportations.
Dobrindt, shortly after assuming his role, ordered an intensification of border checks and authorized the rejection of asylum seekers at the border, although he noted that vulnerable groups, such as pregnant women and children, would be exempt from these measures. This policy has sparked controversy both in Germany and among neighboring countries, raising questions about its legal foundation.
Critics, including representatives from the Green Party, argue that this approach violates EU law. Sven Giegold, a leading figure within the party, has urged European Commission President Ursula von der Leyen to initiate infringement proceedings against Germany, citing concerns over the government's recent directives.
In defense of his measures, Dobrindt claimed that the number of deportations has surged by 45 percent since the enforcement of stricter border controls. He reported that the Federal Police returned 739 individuals at the border, a significant increase from the previous week when 511 returns were recorded. Among those returned were 32 individuals who had expressed intentions to apply for asylum.
