Potential Systemic Impact on Drug Pricing and SupplyAdditional legal concerns relate to planned cluster tenders for patent-protected medicines with similar therapeutic effects. The draft law would allow health insurers to initiate exclusive or cross-active ingredient tenders for rebate contracts on such drugs. Physicians would be required to prescribe the discounted products preferentially. Legal experts warn that this approach could fundamentally alter the existing system of drug evaluation and pricing, potentially undermining the established benefit assessment process under the AMNOG procedure.
Critics argue that these changes could disrupt the balance between cost control and access to innovative therapies, while also reducing Germany's attractiveness as a location for pharmaceutical research and production. The pharmaceutical sector has already begun to signal a reduction or withdrawal of planned investments in response to the proposed law.
