In a significant development for Elon Musk's social media platform X, the Irish Data Protection Commission (DPC) has initiated an investigation into the handling of personal data from European users. This inquiry focuses on how the platform utilizes publicly shared posts to train its generative AI model, Grok.
The DPC announced the commencement of this investigation following concerns that the processing of personal data may not comply with several key provisions of the General Data Protection Regulation (GDPR). Central to this inquiry is the examination of the legality and transparency surrounding the data processing practices employed by X.
The investigation will assess whether the personal data collected from users' posts on X has been processed lawfully for the purposes of training Grok. This scrutiny follows an earlier procedure initiated by the DPC in August, during which the company agreed to suspend the use of data from European users for AI training after a legal dispute in Irish courts.
Despite these actions, the civil rights organization Noyb expressed dissatisfaction, filing complaints across nine EU countries. They argue that X's data processing practices occur without proper consent from users. Noyb criticized the DPC for seemingly failing to enforce GDPR comprehensively.
In a recent corporate restructuring, Musk's AI venture, xAI, absorbed X, the platform formerly known as Twitter. This internal deal aims to streamline the legal complexities associated with using user data for training Grok.
As part of the broader regulatory landscape, the European Data Protection Board (EDPB) established a task force in mid-2023, prompted by the Irish supervisory authority. This initiative emerged in response to a temporary ban imposed on the AI system by the Italian data protection authority. The EDPB's objective is to ensure uniform enforcement of data protection regulations across the EU and to prevent inconsistent sanctions from various national regulators.
In December, EU data protection authorities released a three-step test for AI systems, focusing on legitimate interests and necessity assessments. This framework aims to provide clearer guidelines for companies utilizing AI technologies.
As the DPC's investigation unfolds, it remains to be seen how X will navigate the complexities of GDPR compliance in the fast-evolving landscape of artificial intelligence.
