The leadership of the CSU has indicated its backing for the SPD's candidate, Frauke Brosius-Gersdorf, for a position on the Federal Constitutional Court. This announcement comes as the Bundestag prepares to fill three vacant judicial posts at Germany's highest court, a process that has historically seen opposition from the Union regarding SPD nominations.
Alexander Hoffmann, the head of the CSU parliamentary group, emphasized the importance of a unified vote among center parties to ensure the functionality of the judiciary in a time where radical factions are more prominent in the Bundestag than ever. He pointed out that achieving a closed vote is vital for maintaining the integrity of the court.
The Bundestag's election committee is scheduled to provide recommendations for the three positions later today, which may include Brosius-Gersdorf, despite previous objections within the Union, particularly concerning her views on abortion rights.
Hoffmann urged his colleagues in the CDU and CSU to support the SPD's nominees, cautioning that a failure to do so could jeopardize the Union's candidate as well. He noted that the current political landscape necessitates a collaborative approach, as the Union's preferred nominee could only be advanced in a broader agreement that includes the SPD's selections.
The Federal Constitutional Court consists of 16 judges, half of whom are appointed by the Bundestag and the other half by the Bundesrat. With three posts currently open for appointment, the CDU/CSU holds the nomination rights for one position, while the SPD is entitled to propose candidates for the remaining two.
Within the election committee, which comprises twelve regular members, a majority of eight votes is required for a recommendation. The CDU/CSU has five votes, while the SPD has two, with the Greens and the Left each holding one. This configuration allows for a majority to be formed even without the participation of the AfD or the Left party, although the Union has a policy against collaborating with these parties.
In the event the committee issues a recommendation, it will be put to a vote in the plenary session of the Bundestag. The vote is currently planned for Friday, starting with the Union's candidate, followed by the SPD's nominees in a subsequent session before the summer recess.
For the plenary vote, a two-thirds majority of the votes cast is required. To avoid reliance on the AfD, both the CDU/CSU and SPD will need the support of the Left and the Greens, assuming all parties are represented according to their relative strength.
Johannes Fechner, the parliamentary director of the SPD's Bundestag faction, has indicated that allowing a nomination from the Left for constitutional judges is reasonable. He highlighted that the necessary two-thirds majority can now only be achieved without the AfD by including the Left party.
For the upcoming vote, the CDU/CSU plans to nominate Judge Günter Spinner from the Federal Labor Court, who has previously received favorable recommendations from current constitutional judges. The SPD intends to propose Brosius-Gersdorf alongside another candidate, Professor Ann-Katrin Kaufhold, confirming this from party sources.
