The ongoing legal battle between Tchibo and discount retailer Aldi Süd over coffee pricing is set to continue, as Tchibo has announced its decision to appeal a recent ruling from the Düsseldorf District Court. This court had dismissed Tchibo's lawsuit aimed at prohibiting Aldi Süd from selling its Barissimo brand coffee below production costs.
Tchibo, a well-known coffee roaster based in Hamburg, claims that Aldi Süd has been consistently offering its private label coffee at prices that undermine market competition since late 2023. The company argued that such pricing practices violate antitrust and competition laws.
In its ruling, the Düsseldorf District Court sided with Aldi Süd, stating that Tchibo's allegations lacked sufficient grounds. The court emphasized that Aldi Süd's pricing strategy was commercially justifiable and did not pose a threat to fair competition in the coffee market. The judges found no evidence suggesting that Aldi Süd intended to eliminate competitors from the marketplace.
A representative from Tchibo expressed the company's belief that the case holds significant implications for the industry and highlighted potential avenues for a successful appeal. The spokesperson noted that they are confident in their position and are prepared to present further arguments in the appellate court.
Should the case proceed to the appellate level, the Düsseldorf Higher Regional Court will oversee the proceedings. There is a possibility that a new trial could involve additional evidence being presented, although this is not guaranteed.
This legal dispute underscores the ongoing challenges within the coffee retail sector, particularly concerning pricing strategies among competitors. Tchibo's commitment to pursuing this matter reflects its determination to safeguard its market position and uphold fair competition standards.
