Kiel - Christian Noel G., a 21-year-old man, is set to face a retrial at the Kiel District Court after his initial sentence for the murder of his ex-girlfriend, 17-year-old Liliana K., was partially overturned by the Federal Court of Justice (BGH). The original sentence, which imposed a five-year juvenile detention for bodily harm resulting in death, has been called into question due to identified errors in the assessment of evidence.
The BGH's decision came in response to appeals from both the prosecution and the co-plaintiff, leading to a reevaluation of the case that will begin on October 7. This new trial will be held behind closed doors.
The prosecution argues that G. acted with a reckless disregard for his ex-girlfriend's life, which could result in a more severe penalty should the court agree with this perspective. In the first trial, the court did not recognize intent, resulting in a sentence significantly lower than the eight years that the prosecution sought.
Liliana K. tragically lost her life at the age of 17. During the initial proceedings, G. admitted to the act but claimed that he did not intend to kill her. He expressed feelings of betrayal due to her close relationship with a former boyfriend. On the day of the incident, October 18, 2023, G. encountered both Liliana and her former partner at the main train station. They subsequently traveled in a friend's car to a location to discuss matters privately, where a dispute escalated to violence.
During the altercation in the car, G. reportedly brandished a kitchen knife and struck Liliana when she screamed. He later attempted to rush her to the hospital after realizing she had been injured. However, their journey was interrupted by a severe car accident in downtown Kiel, where G. lost control of the vehicle. The young woman succumbed to her injuries, which included a fatal stab wound to the heart.
The upcoming retrial is scheduled to include ten hearings by December 16, with the court expected to reexamine the circumstances and motivations behind G.'s actions.
