The incident in question occurred on Christmas Eve 2021, when unidentified intruders stole an extensive collection of jewelry from the Pooth family's villa near Düsseldorf. Despite ongoing investigations, the perpetrators remain unidentified, and the stolen items--including pieces described as having substantial personal and financial value--have not been recovered.
Following the theft, the Pooths reviewed their insurance arrangements and argued that their broker had failed in their professional obligations. According to the plaintiffs, it only became apparent after the burglary that the existing policy did not fully cover the value of their jewelry collection. The insurance coverage had been increased to over one million euros in 2020, with a specific allocation of 650,000 euros for valuable items. However, the Pooths asserted that their jewelry was worth more than 1.3 million euros and that the inventory list maintained by the broker was incomplete.
In the aftermath of the theft, the insurer initially indicated it would pay 650,000 euros for valuables and an additional 5,000 euros for cash. Ultimately, a total of 975,000 euros was provided. Nonetheless, the Pooths believed they were entitled to a further 675,527 euros based on what they considered to be the true value of the stolen jewelry.
The court rejected their claim, noting in its decision that the Pooths had not previously disputed the list of insured items provided by the broker. The court found no evidence of negligence or breach of duty on the part of the insurance broker, as the inventory list had been available and uncontested prior to the burglary. The broker had also denied the allegations of professional misconduct.
During the legal proceedings, the court suggested a compromise, proposing that the Pooths accept a settlement equivalent to one-third of their claimed additional damages. While the Pooths were open to this solution, the broker declined, resulting in the case proceeding to a final verdict in favor of the broker.
The court's decision is not yet final, as the Pooths have the right to appeal to the Düsseldorf Higher Regional Court within one month. The unresolved status of the original burglary continues to add a layer of personal and financial strain to the case. Law enforcement agencies have stated that their investigation into the theft has been suspended due to a lack of leads, and the whereabouts of the stolen jewelry remain unknown.
This case highlights the complexities involved in insuring high-value personal assets and the importance of maintaining accurate and up-to-date inventories for insurance purposes.
