The Data Protection Authority of North Rhine-Westphalia (NRW) has issued recommendations to schools regarding the handling of smartphone photography and videography on campus. In conjunction with the national Digital Day initiative themed around digital security and trust, the state data protection office emphasized the necessity for schools to educate students about the implications of taking and sharing images and videos. The guidance suggests that schools should introduce explicit rules about the use of mobile phones for photography and videography in their codes of conduct, tailored to different age groups.
According to the data protection authority, students may record images or videos of others during school activities only if explicit consent has been obtained from those who are being photographed or filmed. Furthermore, the use of such recordings should remain within private circles such as family and friends. The authority cautioned against casually uploading photos or videos to social media platforms, highlighting the legal and ethical challenges this presents in terms of privacy and data protection.
Recent incidents have highlighted the risks associated with unauthorized recordings, including instances where students or staff were filmed or photographed without their consent. Some of these cases have even involved the documentation of rule violations or potentially unlawful activities, such as property damage or the use of prohibited slogans. In response to such issues, the NRW Ministry of Education has required schools to formalize age-appropriate rules for private mobile phone usage, ensuring these are reflected in school policies.
When a possible breach of school rules is suspected, school administrators have the authority to request that students voluntarily present specific images or videos stored on their devices for review. However, the data protection authority made it clear that any search of a student's device without their consent is not permitted. In cases where there is a suspicion of criminal activity, schools are advised to involve law enforcement, who possess the appropriate investigative powers.
The data protection office had previously informed schools during enrollment periods that while recording photos or videos is generally allowed, sharing such content on social networks is subject to strict data protection laws. These principles are now being extended throughout the academic year, reinforcing the need for continuous awareness among students, staff, and parents.
