German Court Rules Weight-Loss Injections Classified as Lifestyle Medications

A regional court in Germany has determined that weight-loss injections, such as those containing the active ingredient tirzepatide, are classified as lifestyle medications and are not eligible for reimbursement through the country's statutory health insurance providers.

The Lower Saxony-Bremen Regional Social Court recently reviewed a case brought by a patient whose physician had recommended the drug Mounjaro for weight management after other treatments proved ineffective. The patient's health insurance provider declined to cover the cost, citing the fact that the medication is not approved for the treatment of hormonal disorders and is instead considered a lifestyle product outside its official pharmaceutical indications.

The court upheld the health insurance provider's decision, confirming that weight-loss medications are not included in the statutory health insurance (GKV) benefits catalogue when prescribed solely for weight reduction. This policy applies to both traditional weight-loss pharmaceuticals and newer GLP-1-based injectable drugs such as Wegovy and Mounjaro, provided their use is limited to managing body weight and does not address approved medical indications.

The legal basis for this exclusion is found in Section 34, Paragraph 1, Sentence 7 of the Fifth Book of the German Social Code (SGB V), which specifically removes lifestyle medications from the catalogue of reimbursable services. The rationale is that statutory health insurance is not required to fund every medical advancement or treatment, particularly in cases where the condition is not life-threatening.

This interpretation has been consistently supported by multiple court rulings across Germany. Social courts have repeatedly stated that insurers are not obligated to provide coverage for all available medical products unless they are essential for treating severe or life-threatening diseases.

The debate over whether weight-loss injections should be included in the reimbursement scheme has intensified in recent years, especially as the popularity and demand for these medications have surged. Pharmaceutical manufacturers continue to advocate for their inclusion in the insurance system, arguing for broader access. However, the Federal Joint Committee (G-BA), the authority responsible for determining which medical treatments are covered by statutory health insurance, has ruled out special exemptions for these products. The Federal Ministry of Health has also maintained that weight-loss drugs will remain excluded from insurance reimbursement in the foreseeable future.

With the growing prevalence of obesity and the increasing availability of innovative treatments, the issue continues to be a topic of discussion among healthcare professionals, policymakers, and patient advocacy groups. Nevertheless, under the current legal framework, patients seeking weight-loss injections for non-approved indications must continue to bear the costs themselves.

This ruling reaffirms the statutory health insurance providers' stance that coverage is limited to medications and treatments specifically approved for reimbursable medical indications, reinforcing the boundary between lifestyle and essential medical therapies in the German healthcare system.
