EU Parliament Revokes Immunity of AfD Politician Petr Bystron

Tue 1st Apr, 2025

The European Parliament has voted to revoke the immunity of AfD member Petr Bystron in response to a request from the Munich public prosecutor's office. This decision stems from allegations against Bystron related to the use of symbols associated with unconstitutional organizations, specifically in connection with a controversial collage posted on social media.

Bystron, who has been a member of the European Parliament since May 2024, is being investigated for a collage that was shared on his Twitter account following the dismissal of Ukrainian Ambassador Andrij Melnyk in July 2022. The collage depicted six public figures with their arms raised, an image that the prosecutor's office argues could be interpreted as reminiscent of the Hitler salute.

The parliamentary vote to lift Bystron's immunity was largely supported, aligning with the standard procedure when there are no indications that a politician's legislative duties are being obstructed. The Munich prosecutor had previously sought to charge Bystron with similar allegations in 2022, but that attempt was dismissed by the courts at the time.

In September 2023, the German Bundestag also voted to lift Bystron's immunity, paving the way for legal action. Subsequently, in January 2024, the Munich prosecutor's office sought a fine against him, which Bystron contested. To facilitate further legal proceedings following his election to the European Parliament, the prosecutor had to initiate another request to remove his immunity.

Bystron's defense has claimed that the collage falls under the protection of artistic freedom. His legal representatives argue that the images used in the collage were taken from various public figures who have raised their arms in contexts that are not necessarily associated with the Nazi salute.

This situation continues to unfold as legal proceedings against Bystron are anticipated. The case has sparked significant discussion regarding the boundaries of political expression and the responsibilities of elected officials in relation to their public statements and actions.
