In a significant development regarding the Sommermärchen scandal, the Frankfurt District Court has decided to terminate the legal proceedings against former DFB President Theo Zwanziger. This verdict comes after a thorough examination of the case, which revolved around a controversial payment of EUR6.7 million made by the German Football Association (DFB) to FIFA in April 2005.
The court's ruling followed a nearly six-hour testimony during which key points made by Zwanziger were acknowledged by the court. His lawyer, Hans-Jörg Metz, emphasized that the court's conclusions indicate that Zwanziger acted transparently and did not engage in any deceptive practices. He asserted that Zwanziger was not guilty of tax evasion, and characterized the decision as a significant vindication for his client.
Metz highlighted that Zwanziger did not 'buy his freedom' through this legal resolution but rather facilitated a conclusion to nearly a decade-long investigation involving legal proceedings in both Switzerland and Germany. The attorney noted that the financial penalties imposed were substantially lower compared to those faced by other individuals involved in the case, such as Wolfgang Niersbach and Horst R. Schmidt.
The crux of the case lay in the DFB's classification of the EUR6.7 million payment as a legitimate business expense, a classification that the prosecution argued was improper. This payment was allegedly linked to a return of a loan made to the late Robert Louis-Dreyfus, which had originally been issued to Franz Beckenbauer in 2002. The money was subsequently funneled to Qatar, raising suspicions of a bribe aimed at securing FIFA support for the World Cup.
Judge Eva-Marie Distler remarked that the payment was effectively a 'bribe' intended to guarantee financial assistance from FIFA for the World Cup, which amounted to CHF 250 million. The DFB had purportedly disguised this transaction as a contribution to a gala event that was eventually canceled due to budget constraints.
Despite the dismissal of charges against Zwanziger, the DFB continues to face scrutiny. The prosecution has maintained its stance against the organization, which still risks losing a potential tax refund estimated at around EUR22 million. This potential loss arose following the revocation of the DFB's tax-exempt status in 2017 as part of the Sommermärchen affair.
This ruling marks a pivotal moment in the ongoing fallout from the scandal that has cast a long shadow over German football, raising questions about transparency and ethics within the sport's governing bodies.
