The Hamburg District Court is currently handling the case known as the 'Zytoservice Case.' The public prosecutor's office in Hamburg has filed charges against six officials from the Alanta Health Group for serious bribery and organized billing fraud amounting to millions of euros. The allegations suggest that these individuals used bribery to persuade physicians to prescribe chemotherapy agents manufactured by their own pharmacies.
According to the charges, the accused include two pharmacists and four senior executives from their companies. The Alanta Health Group has denied the allegations, asserting in a statement that it is confident the charges will be disproven in court.
As detailed by the prosecution, the defendants allegedly acquired the Mümmelmannsberg neighborhood clinic and established several medical care centers in order to maximize the client base for their drug formulations while circumventing legal prohibitions against collaborations between pharmaceutical service providers and contracted doctors.
In a total of 340 instances, they are accused of submitting non-billable prescriptions to statutory health insurance providers, leading to payments exceeding 75 million euros. This case is set to be heard by the economic criminal chamber of the district court.
In addition, investigations are ongoing against 47 physicians related to this case for suspected bribery. However, the proceedings against these doctors have been separated from the current case, according to a spokesperson from the public prosecutor's office. Investigations in this matter are still in progress.
The public prosecutor's office has been investigating pharmacists, doctors, and pharmaceutical managers for several years. In 2019, raids were conducted at the premises of the Alanta Health Group, its subsidiary Zytoservice GmbH, and the Mümmelmannsberg neighborhood clinic, resulting in the seizure of over 6,000 file folders and approximately 100 data carriers.
